DPMAregister

a) Provision of DPMAregister and creation of log files

    • (1) Data processing

When DPMAregister is used, our system automatically collects data and information of the computer system of the accessing computer. In this process, the following data will be collected:

  • IP address
  • File transferred
  • Size of file transferred
  • Date and time of access
  • Browser used/operating system used
  • Whether access was successful
  • Processing time of access

The data will also be stored in the log files of our system. These data will not be stored together with your other personal data.

    • (2) Legal basis

The legal basis for the temporary storage of data and log files is point (e) of Article 6(1), Article 6(3) of the General Data Protection Regulation in conjunction with Section 3 of the Federal Data Protection Act. The DPMA has the statutory duty to inform the public about IP rights valid in Germany.

    • (3) Purpose of data processing

The logged data are used solely for the purpose of ensuring the security of the system and optimising our web services.
The temporary storage of the IP address by the system is necessary so that, in the event of attacks on DPMA systems, the origin of the attacks can be identified promptly and suitable countermeasures can be initiated.
The data are stored in log files to ensure the functioning of the web service. In this context, the data are not being analysed for marketing purposes.

    • (4) Duration of storage

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. The IP addresses are stored for seven days, after which they are anonymised in the log files by an automatic procedure.
The remaining data are stored for 35 days.

    • (5) Option of objecting and of removal

The collection of data for the provision of the web service and the storage of data in log files is absolutely indispensable for the operation of the web service. Therefore, there is no option to object.

    • (6) Rights of data subjects

b) Use of cookies

    • (1) Data processing

We use cookies for the DPMAregister online service. Cookies are text files that are stored in the Internet browser or by the Internet browser on your computer system. When you visit a website, a cookie may be stored on your operating system. This cookie contains a characteristic character string that enables a unique identification of the browser when the website is revisited.

    • (2) Legal basis

The legal basis for the processing of personal data using cookies is point (e) of Article 6(1), Article 6(3) of the General Data Protection Regulation in conjunction with Section 3 of the Federal Data Protection Act. In our DPMAregister service we make the statutory publications on patents, utility models, trade marks and designs available to you as well as the register data. Here you can search for legal (and procedural) status information as well as publication data. For this purpose, it is necessary to buffer your entered data. In addition, user configurations (e.g. hits per page) will be stored. The administration and publication of IP applications, in particular for search purposes, is a task of the DPMA.

    • (3) Purpose of data processing

The purpose of using cookies is to buffer data entered and to store user configurations.
The user data collected by the cookies are not used to create user profiles.

    • (4) Duration of storage, option of objecting and of removal

Cookies are stored on your computer and transmitted by it to us. Therefore, you as a user also have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies already stored can be deleted any time. This can also be carried out automatically. If cookies are deactivated for our web service, it may be possible that not all functions of the web service can be fully used.

    • (5) Rights of data subjects

Information on your rights as data subject is available in section Rights of data subjects.

c) Registration for DPMAkurier

    • (1) Data processing

You can register for the DPMAkurier service on our DPMAregister webpage, indicating your personal data. After entering the data in an input screen, they will be transmitted to us and stored. The data will not be passed on to third parties.
The following data are collected in connection with the registration procedure:

  • Name
  • E-mail
  • Password
  • Password question

By registering, you consent to the processing of your personal data for the purpose of sending out information via DPMAkurier.
The following data is logged on the web server at the time of registration:

  • IP address
  • File transferred
  • Size of file transferred
  • Date and time of access
  • Browser used/operating system used
  • Processing time of access
  • Whether access was successful

    • (2) Legal basis

The legal basis for the processing of data after the user registered for DPMAkurier is point (a) of Article 6(1) of the General Data Protection Regulation.
The legal basis for the temporary storage of log data is point (e) of Article 6(1), Article 6(3) of the General Data Protection Regulation in conjunction with Section 3 of the Federal Data Protection Act. The DPMA has the statutory duty to inform the public about IP rights valid in Germany.

    • (3) Purpose of data processing

The purpose of collecting your e-mail address is to enable you to subscribe to the monitoring of IP rights and then automatically receive the results by e-mail. The data will exclusively be used for correspondence with you.
The logged data are used solely for the purpose of ensuring the security of the system and optimising our web services.

    • (4) Duration of storage

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. This is the case for the data collected during the registration process if the registration on our website is cancelled or modified.
The IP addresses are stored on the web server for seven days, after which they are anonymised in the log files by an automatic procedure.
The remaining data are stored for 35 days.

    • (5) Option of objecting and of removal

As a user you can cancel your registration any time. You can have the data stored about you modified any time. For this purpose, you can send an e-mail to the specified e-mail address.
The collection and storage of log data is absolutely indispensable for the operation of the web service. Therefore, there is no option to object.

    • (6) Rights of data subjects
